1. These terms

This website, www.topsailappliances.com, is published by Topsail Appliances Pvt. Ltd., whose factory and office are at Gala No 27 to 32, Srv No 295/1, RCC Industrial, Abhay Industrial Hub, Naroli, Silvassa, Dadra & Nagar Haveli 396235, India. In these terms "we", "us" and "Topsail" mean that company, and "you" means you, whether you are browsing on your own account or for a business.

By using this site you accept these terms. If you do not accept them, please stop using the site. If you are using it for a business, you confirm you have authority to accept these terms on its behalf.

2. What this site is, and is not

This is an information site for an original equipment manufacturer. It describes what we make, what our factory can do and how a brand can work with us. It exists so a prospective brand partner can decide whether to start a conversation.

It is not a shop. You cannot buy anything here. We do not sell to consumers through this site, we take no orders and no payments through it, and there is nothing to register for or log into. The only thing you can do here is send us an enquiry.

3. Nothing here is a binding offer

Everything published on this site, including product descriptions, categories, capabilities, capacities, lead times, minimum order quantities and any indication of price, is information and is not an offer capable of acceptance. The same applies to anything we say in reply to an enquiry, by email or on WhatsApp, before terms are agreed.

A supply arrangement between us exists only once it is recorded in writing and signed or confirmed in writing by both sides: a quotation we have formally issued and you have accepted, a purchase order we have accepted, or a manufacturing or supply agreement. Where such a document exists it governs, and if it conflicts with anything on this website, the signed document wins.

4. Product, specification and certification information

We work to keep the technical information here accurate and current, but products evolve, tooling changes and standards get revised. Specifications, materials, finishes, dimensions, wattages, capacities and feature lists shown here are indicative and may change without notice. Product photography and renders are illustrative, and the finish, colour and packaging of a unit built for your brand will be whatever we agree with you in writing.

Where we refer to certifications and approvals, including BIS and ISI for India and others for export markets, those statements describe the scope held at the time of writing for particular products or product families. Certification is product specific and market specific. Please do not treat a page on this website as evidence that a given unit is certified for a given market. Ask us and we will send the current certificate for the exact product, and confirm in writing what is certified and what is not before you commit.

Volumes, timelines and savings mentioned anywhere on this site, including on the blog and in case studies, describe what was achieved in specific past projects. They are not a promise of what your project will achieve.

5. Intellectual property

All content on this site, including text, photography, video, illustrations, page design, the Topsail Appliances name and logo, and the names of our own products and software, belongs to us or to our licensors and is protected by Indian and international intellectual property law.

You may read, print and share pages for your own reference or to evaluate us as a supplier. You may quote short extracts with attribution and a link. You may not republish our content wholesale, present it as your own, use it to train a commercial machine learning model, or use our name, logo or photography in a way that suggests a partnership or endorsement that does not exist.

Third-party brands, logos and products shown on this site remain the property of their owners. Where we show work done for a brand partner, the design and brand rights in that work remain theirs.

In an original equipment manufacturing arrangement the brand partner keeps ownership of its own designs, trade marks and specifications, and we manufacture to those specifications. The detail sits in the agreement between us, not here.

6. Confidentiality and your enquiry

Please do not send confidential designs, drawings or commercially sensitive specifications through the enquiry form or over WhatsApp as a first step. Tell us the shape of the project instead, and we will sign a non-disclosure agreement before any detailed technical discussion. We are glad to do this and we do it routinely.

Information you do send is handled as described in our privacy policy. Nothing you send through this website creates a confidentiality obligation on us by itself. That obligation comes from a signed non-disclosure agreement.

7. Acceptable use

You agree not to:

• Use the site for any unlawful purpose or in breach of Indian law.
• Submit false, impersonating or deliberately misleading information through the enquiry form, or use it to send unsolicited commercial messages.
• Attempt to gain unauthorised access to the site, its hosting, its functions or any connected system, or probe, scan or test its security.
• Scrape, crawl or harvest the site in a way that places an unreasonable load on it, or extract our content at scale for republication.
• Introduce any virus, malware or harmful code, or interfere with the site's availability.

8. Links, embeds and WhatsApp

This site links out to other sites and embeds material hosted elsewhere, including video and messaging. We do not control those services and are not responsible for their content, their terms or their privacy practices. When you follow a WhatsApp link from this site you leave it, and the conversation that follows is governed by WhatsApp's own terms.

9. Our articles are not professional advice

The blog here discusses manufacturing, sourcing, certification, import substitution, duty structures and policy schemes. It reflects our practical experience and our reading of the rules at the time of writing. It is commentary, not legal, tax, regulatory, customs or investment advice, and rules change. Take professional advice on your own situation before acting on anything you read here.

10. Availability and changes

We may change, move or withdraw any part of this site at any time, and we may change these terms. The version published here is the version in force, and the date at the top records when it last changed. Continuing to use the site after a change means you accept the updated terms.

We do not promise the site will always be available or free of errors, and we may suspend access for maintenance or for any other reason without notice.

11. Disclaimers and limits on liability

The site and its content are provided as they are, without warranty of accuracy, completeness, fitness for a particular purpose or uninterrupted availability, to the fullest extent permitted by law.

To the fullest extent permitted by law we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, business, contracts or anticipated savings, arising from your use of this site or your reliance on anything published on it. Nothing in these terms limits any liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.

Our liability under any actual supply arrangement is governed by the agreement for that arrangement and is neither limited nor extended by this page.

12. Privacy

How we handle personal data, what the enquiry form collects, where it goes, what analytics we run and what rights you have under the Digital Personal Data Protection Act, 2023 are all set out in our privacy policy, which forms part of these terms.

13. Governing law and jurisdiction

These terms, and any dispute arising from them or from your use of this site, are governed by the laws of India. The courts at Silvassa, Dadra and Nagar Haveli shall have exclusive jurisdiction, and you and we both submit to it.
